Article 1 (Purpose)

This Policy sets forth the information handled by the Application, the places in which such information is stored, the extent to which any such information is made available to the Developer or to any third party, and the means available to the User with respect to such information.

Article 2 (Definitions)

In this Policy, the following terms shall have the meanings set forth below:

  • (a) "User" means any person who installs or uses the Application;
  • (b) "Photo Library" means the photographs and videos on the device of the User, together with their metadata, such as the date and place at which they were taken;
  • (c) "App Records" means the records the Application keeps of its own use, namely which items of the Photo Library the User has already seen, the photographs, days and periods the User has hidden, the items marked for deletion, statistics of the groups the User has finished, and the settings of the Application; and
  • (d) "Usage Data" means the usage statistics concerning the Application that are collected by means of Google Firebase Analytics, as further specified in this Policy.

Article 3 (Information Handled)

The Application does not require or offer a user account, contains no advertising, and does not track the User across applications or websites.

The Application reads the Photo Library on the device of the User in order to show it to the User. Photographs and videos are never uploaded to the Developer or to any third party by the Application, and the Developer has no access to them. App Records are stored on the device of the User and are not transmitted to the Developer.

In the iOS version of the Application, information leaves the device of the User only in the following cases, each of which is described in this Policy: Usage Data; feedback the User chooses to send; the place of a photograph whose information the User opens; the optional iCloud sync of Shubo Pro; and the processing of purchases by Apple.

Article 4 (Usage Statistics)

In order to improve the Application, the Application uses Google Firebase Analytics to collect Usage Data. Usage Data consists of (a) events concerning the use of the Application, namely the screens viewed, the start, completion and abandonment of a group, whether each item was kept or marked for deletion together with whether it is a photograph or a video, the number and total size of the items deleted, the outcome of a request for access to the Photo Library, the opening of features of the Application, the hiding and unhiding of items, changes to settings, the display of the purchase screen and the outcome of a purchase, and whether the User has purchased Shubo Pro; and (b) the information that Google Firebase Analytics records for any application, such as the device model, the operating system version, the version of the Application, the language of the device, an approximate location derived by Google from the network address of the device, and the times at which the Application is opened.

Usage Data never includes any photograph or video, its contents, its name, the date or place at which it was taken, or the text of any feedback. Usage Data is associated with a randomly generated identifier assigned to the installation of the Application, and not with the name of any User or with any account. The Application does not collect the advertising identifier of the device, does not permit Usage Data to be used for advertising or personalised advertising, and does not register with any advertising network.

The Developer uses Usage Data solely for the purposes of understanding how the Application is used and improving it. Usage Data is processed on behalf of the Developer by Google (see Firebase privacy information).

Article 5 (Access to Functions of the Device)

The Application uses the following functions of the device only for the purpose stated:

  • (a) Photo Library: the Application asks for access to the Photo Library in order to choose items from it at random and show them to the User. Where the User grants access to selected items only, the Application uses those items only. The Application deletes an item, or marks it as a favourite, only after the User confirms it in a dialog of the operating system, and a deleted item is moved to the recently deleted items of the device, from which the User may recover it within the period set by the operating system.
  • (b) Notifications: where the User turns on the daily reminder, the reminder is scheduled on the device by the Application and is delivered by the operating system; no reminder is sent through any server.

The Application does not use the camera, the microphone, the location of the device, the contacts of the User, or any other protected function of the device. The place shown for a photograph is read from the metadata of that photograph, and not from the location of the device.

Article 6 (Place Names of Photographs)

In the iOS version of the Application, where the User opens the information about a photograph that carries the place at which it was taken, the Application shows a map of that place and its name by means of Apple Maps, and for that purpose sends the coordinates of that place to Apple. The coordinates are not sent together with the photograph or with any identifier of the User, and are handled by Apple in accordance with its own privacy policy. The Developer does not receive them.

Article 7 (Storage and Backup)

App Records are stored on the device of the User.

In the iOS version of the Application, App Records are included in the backup of the device that the User makes to iCloud or to a computer, so that they can be restored together with the device. Where the User has purchased Shubo Pro and turns on the setting to sync what the User has seen with iCloud, which is off unless the User turns it on, the list of identifiers of the items of the Photo Library the User has seen is stored in the private database of the User's own iCloud account (CloudKit), so that it can be kept across the devices of the User. Such data contains no photograph or video, is held by Apple under the User's iCloud account, is subject to the terms between the User and Apple, and is not accessible to the Developer.

Article 8 (Purchases)

Shubo Pro is sold and processed by Apple through the App Store. The Developer does not receive the name, payment details or Apple Account of the User; the Application learns from Apple only whether Shubo Pro has been purchased.

Article 9 (Feedback)

Where the User chooses to send feedback from within the Application, the Application sends to the server of the Developer the message the User writes, the email address of the User if, and only if, the User enters one in order to receive a reply, the version of the Application and of the operating system, the platform of the device, and whether Shubo Pro has been purchased. Nothing is sent until the User sends the message. The Developer uses such information solely to read and reply to that message and to improve the Application, and does not share it with any third party.

Article 10 (Children)

The Application is not directed to children, and the Developer does not knowingly collect information from children.

Article 11 (Deletion of Information)

The User may reset what the User has seen and unhide hidden items within the Application, and the uninstallation of the Application deletes all data stored by the Application on the device of the User. Uninstalling the Application does not delete any item of the Photo Library.

Resetting what the User has seen also deletes the copy kept in the User's iCloud account. Such data may also be deleted by the User in the iCloud storage settings of the device, where the data of the Application is listed under its name.

The User may request the deletion of any feedback the User has sent, or of Usage Data associated with the installation of the Application, by contacting the Developer at the address set forth in the Article entitled "Contact".

Article 12 (Amendment of this Policy)

The Developer may amend this Policy from time to time. In the event of any such amendment, the Developer shall revise the date of last update indicated at the top of this page.

Article 13 (Contact)

Inquiries concerning this Policy shall be directed to the Developer at support@shosin-labs.com.
